NAT Fraser does not yet know whether he will face a re-trial for the 1998 murder of his wife Arlene.
A hearing to decide on a possible retrial and quashing of his 2003 conviction for murder has been adjourned until June 17.
At the Court of Criminal Appeal in Edinburgh on Wednesday, Fraser's legal team argued against a retrial.
The Crown said it accepts the quashing of his conviction but still wishes to seek fresh proceedings against Fraser (52).
Last month Fraser won his appeal to the UK Supreme Court in London which ruled he had not received a fair trial in 2003 after crucial evidence was not disclosed to his defence.
The Supreme Court remitted the case back to the Court of Criminal Appeal in Edinburgh to decide on a retrial and to quash the conviction.
The Crown Office said it would seek to bring fresh proceedings against Nat Fraser, which would have to take place within two months.
Judges at the Appeal Court on Wednesday considered legal submissions from both sides.
