Court in Moray: Elgin drink-driver was 'visibly shaking'

An Elgin pensioner who was found to be two times over the drink driving limit is seeking help for alcohol abuse.

Elgin Sheriff Court heard Terence Ferguson state he'd had his last drink 14 hours before testing positive.

The 68 year-old was stopped during July 8 on Fortreath Avenue, Elgin for an unrelated matter.

However, when the police offered noticed he was "visibly shaking" they decided to test him.

He gave a reading of 56 – the legal limit is 22.

Ferguson, who lives in Moray Street, represented himself in court.

Sheriff Olga Pasportnikov asked: "Could you please explain how you came to be driving?"

He replied: "I thought I was under the limit. It had been 14 hours since I had my last drink so I thought I would be all right.

"Now I am seeking help."

Ferguson was handed an £800 fine, plus a £40 victim surcharge, and disqualified from driving for 15 months.

However, he was offered a drink driver awareness course, which could reduce the ban to 12 months.
