The officer and a colleague saw Leslie Robertson lying in a stairwell in Elgin's Masonic Close on December 30 last year.

But when they tried to help the 41-year-old to his feet he lashed out.

Speaking at Inverness Sheriff Court today, fiscal depute Robert Weir said: "He was arrested and as they attempted to restrain Robertson, he spat at one.

"He was handcuffed to the rear and placed into a spit hood but continued to repeatedly spit.

"He also continued to kick out with his legs and straps were applied.

"Robertson was taken to Elgin Police Office where he was aggressive and abusive throughout, and refused to comply with the procedures."

Defence solicitor Stephen Carty told the court that his client, who lives on Morriston Road, Elgin, had a "long-standing drug problem".

Noting Robertson's previous convictions, Sheriff Margaret Neilson commented: "It is disgusting particularly as it was during the Covid pandemic."

She deferred sentence until October 11 for a background report and allowed Robertson's bail to be continued.
