Luke Clarkson (27) who is formerly of Elgin, committed the painful sex attack on his then 18-year-old victim at a flat in Dundee in January 2020.

Clarkson who was jailed for four years and nine months yesterday, was asked to stop during the assault but only ceased after his victim had grabbed him by the throat.

Clarkson had earlier denied raping the teenager at a flat in Dundee on January 19 2020 but was found guilty after a trial.

He was also convicted of engaging in abusive behaviour towards the woman over several months, leading up to the incident in January 2020 during which he pushed and grabbed her, hit her with an ornament and seized her by the throat.

Lord Boyd of Duncansby said he had a victim impact statement from the woman who suffered injury during the assault and added that it was the psychological damage she had experienced that was "most debilitating and long lasting".

A judge told Clarkson that he had shown no remorse for his offending against the woman.

The judge said: "She had repeatedly asked you to stop. You only did so when she eventually grabbed you by the throat."

Defence counsel Edith Forrest said that Clarkson continued to maintain his innocence but was prepared to undertake whatever courses were available to him.

She said the former McDonalds restaurant employee had suffered from "adverse childhood experiences''.

Miss Forrest said: "He appears as a true first offender. Until this offence he had no contact with the police or the criminal justice system."

She said that Clarkson, formerly of Elgin, in Moray, had an interest in martial arts and for a time had employment in that field.

Clarkson was also told that he will be on the sex offenders' register indefinitely following his sentencing.
