Elgin sex offender jailed for 28 months

An Elgin sex offender who was subject to a High Court lifelong restriction order was released in July 2019 only to re-offend in 2020.

David Mackenzie filmed unwitting women and children in streets and on bus journeys between Elgin and Forres where he worked.

Inverness Sheriff Court was told he would pursue different victims on a daily basis so he could record their clothed private parts.

Mackenzie had been convicted in September 2008 of a sex offence at the High Court, jailed for 18 months but placed on the life order.

Today he admitted conducting himself in a disorderly manner by recording women and children for sexual gratification between March 5 and April 23.

He also admitted a contravention of Sex Offender Registration requirements by using four aliases to go on adult web chat sites without notifying his supervising officers.

Defence solicitor Stephen Carty told Sheriff Gary Aitken that his client had spent 10 years in prison before being released on licence last year.

Mr Carty added that his 32-year-old client had successfully completed various programme in custody which satisfied the parole board that coping mechanisms were in place for him at liberty.

"But it began to go downhill at the beginning of March when he had personal difficulties. The coping mechanisms which were in place fell by the wayside. He recognises that his recall to prison will be for a significant period." Mr Carty added.

Jailing him for 28 months, Sheriff Aitken told Mackenzie that the "serious nature of the charges meant that whatever I do, to some extent, will be academic as it is likely you will be in a custodial setting for some considerable time.

"But it is to your credit that you accept that you have further work to do to address your behaviour."
