Elgin man in court after being caught having sex beside A96 on CCTV
A man has appeared in court after being caught on CCTV having sex just yards from the A96.
The 30-year-old was arrested after being spotted engaged in sexual activity on grassland in Elgin with a woman he’d been legally banned from seeing.
Elgin Sheriff Court heard that two police officers were on patrol in the town at 2.25am on Saturday, January 27, when they received a call from the control room.
A colleague monitoring the town’s CCTV cameras informed them a couple were engaged in sexual activity on Blackfriars Road.
The court heard that, although the grassy area was hidden from motorists on the A96, the couple were visible on a nearby camera.
Procurator Fiscal Karen Poke said: “The police officers arrived shortly after. The accused immediately jumped to his feet and ran off.
“The female remained where she was. The officers established that she was safe and well.
“The accused then returned to the scene a short time later and apologised for running away.
“A check was carried out and it was learned that the accused was in breach of a bail condition not to contact the woman.”
Jordan Stewart, of Whytes Place, Elgin, pleaded guilty to one charge of breaching his bail and a second charge of engaging in sexual activity in a public place.
He was ordered to carry out 200 hours of unpaid work for the community.
