Court in Moray: Man with tyre iron punched love rival

A man has received community service after punching his victim while holding a tyre iron.

Troy Sutherland threatened his ex-partner and her new lover as they emerged from a parked car.

Elgin Sheriff Court heard that the new partner was punched in the head while dropping off a safety camera in Fochabers.

Fiscal depute Victoria Silver said that Sutherland was drunk when he suddenly appeared holding a metal bar.

She said: "He then made a threat, 'You are getting it, you are f****** getting it'.

"The victim received injuries to his nose and mouth and was transferred to Dr Gray's Hospital for examination."

Sutherland, who now lives in Peterhead, pleaded guilty to the assault which took place on September 4 last year.

Ben Thom, who was representing the 27-year-old, said: "He acknowledges that his behaviour was serious but there is an alternative to a custodial sentence available.

"At the time, Mr Sutherland acted in this way due to his relationship with alcohol and his deteriorating mental health was also a factor.

"He has since been engaging with services at Royal Cornhill Hospital."

Sheriff Olga Pasportnikov handed Sutherland 160 hours of community service, to be completed within the next 12 months, along with two years of supervision and an alcohol and drug rehabilitation order.
