Parliament must be recalled immediately, says Moray's MSP

Scotland’s Court of Session has today ruled that the suspension Parliament is “unlawful”.

Following that judgment Richard Lochhead is now calling for the House of Commons to be recalled immediately

In a summary of their findings, the Court of Session judges said they were unanimous in their belief that Boris Johnson's decision to suspend was motivated by the "improper purpose of stymying Parliament".

Commenting Moray’s MSP said: "Following the extraordinary judgement in Scotland’s highest court that Boris Johnson’s advice to HM the Queen and the suspension of Parliament was unlawful, there is no question that Parliament must now be recalled.

"Given that the shutdown of Westminster has been ruled illegal, I would expect Moray’s Conservative MP to be putting pressure on his government colleagues to recall parliament immediately. He should be standing up for the law not Boris Johnson."

The case was originally dismissed at the Court of Session last week.

But three judges of the Inner House, the supreme civil court in Scotland, disagreed with that ruling today.

The UK government plans to appeal the latest ruling at the Supreme Court – the highest judicial body in the country – and has promised to respect the final result.
