Drink driver had argued with ex-partner

A man drove a short distance while over the limit after getting into an argument with his ex-partner.

Elgin Sheriff Court heard that Shane Rollo and his former partner had both been drinking the night before.

At about 8am the following morning they got into a dispute and he left the property.

The police traced him at a nearby house in Elgin at 11am.

A breath test administered in Elgin Police Station at 11.55am gave a reading of 39, compared to the legal limit of 22.

Defence solicitor Matthew O'Neill said: "Having slept for some time he thought he was fit and able to drive. It was a mistake."

Rollo, of Dunbar Street, Lossiemouth, admitted the drink driving offence.

In addition he also admitted a charge of acting in a manner likely to cause alarm.

This related to the argument with his ex-partner, during which he grabbed her by the shoulders.

Rollo was banned from the roads for 12 months and fined £470.

The 35-year-old was told he can get his licence back after nine months if he pays for and passes a drink-driving awareness course.
