Dufftown man who caused disturbance at Elgin hotel and spat water at police officer jailed

A DUFFTOWN man who had been arrested for a disturbance at an Elgin hotel spat water at an officer while in a police cell.

James Wilson of Braehead Crescent, Dufftown appeared at Inverness Sheriff Court by video link. The 39-year-old who is currently serving a custodial sentence in England, admitted a breach of bail by being in the company of his partner at the Travelodge in Elgin on October 15, 2022.

Fiscal depute Susan Love said that Wilson and the woman got drunk and police were called to a disturbance involving the pair in the hotel car park.

She added: "He was unruly and was arrested. In the police cell, he was drinking from a glass of water when he spat it at a constable. It hit him on the shoulder area after he managed to avoid it entering his mouth."

Wilson also pleaded guilty to assault.

His defence solicitor, Matthew O'Neill said his client had problems with alcohol. He added: "He has no access to alcohol in prison but is still engaging with support services. His partner found out he was staying temporarily at the hotel and went there.

"He had been asking for a glass of water for some time and he accepts it was a stupid and disgusting thing to do."

Wilson was jailed for nine months, starting immediately.

The court had been told that Wilson's earlier release date was October 7, 2023 and it is unlikely the custodial sentence will have a significant effect on his liberation.
