On December 29 2022, drivers on Elgin's East Road had spotted 33-year-old Scott Adams staggering along the pavement and onto the road beside Burger King, forcing several people to stop their cars or break during busy traffic.

A witness then saw Adams, who appeared to be intoxicated, fall over and stopped the car to ask he was okay. Adams then ran straight at the window of the car and punched the passer-by in the face.

After his arrest Adams also behaved in a threatening or abusive manner towards officers at Elgin police station, by shouting and swearing at them and threatening them.

Defence Solicitor Grant Dalgluish stated that his client had been "open and honest that he has substance issues and has taken responsibility for his actions at the earliest opportunity."

Sheriff David Sutherland handed Adams a community payback order of 120 hours and a one year supervision order.
