Elgin Sheriff Court heard that at around 1am on September 25 last year, Alan Mackenzie was seen driving his blue Audi through Elgin.

The 52-year-old was described by one witness as being 'all over the place' and narrowly avoided colliding into the wall of a filling station on East Road.

A woman, who followed Mackenzie, called the police.

Officers then found him near the town's bus station with the engine still running on his vehicle and the lights on.

Mackenzie immediately confessed to being under the influence of alcohol telling police "I'm drunk".

He gave a reading of 94mcg of alcohol in 100ml of breath at Elgin Police Station at around 2am that night.

Defence solicitor Kevin Anderson said that his client had been drinking at a social event prior to the incident.

After having a disagreement with his wife, he took the "foolish decision" to get into his car and drive away.

However, Mackenzie, who works as a driver, pulled over upon realising what he was doing.

He then phoned his boss to pick him up but police arrived before he could get there.

Mr Anderson said: "He understands that his employment will be lost to him.

"But his biggest regret is that he has failed his 83-year-old mother who relies on him for support."

Sheriff Olga Pasportnikov disqualified Mackenzie from driving for 16 months and fined him £520.

He could reduce that ban by four months if he completes a drink driver rehabilitation course.
