Elgin woman (52) spat at police officer and said: "Do as I say or I will batter you"

AN ELGIN woman threatened to 'batter' a police officer after being taken to hospital due to concerns for her welfare.

Inverness Sheriff Court was told that Wendy Stuart (52), of Gordon Street, New Elgin, was taken to Dr Gray's by police on May 9, 2022, but began shouting and swearing in the busy hospital.

Stuart, who was drunk and later spat at an officer, admitted threatening or abusive behaviour and assault.

Senior fiscal depute Alison Young told Sheriff Sara Matheson: "She pushed into the face of one constable and was saying 'I am the one in control here. You will do as I say or I will batter you.'

"Police put handcuffs on her but she refused to calm down. It was decided to take her back to the police station and as she was being put in the vehicle, she kicked at a constable and spat twice at her.

"A spit hood was put on her. She was clearly intoxicated."

Her lawyer, Laura-Jane McFarlane, said: "She is very embarrassed by being here.

"The main issue is her alcohol intake. She has sought help and has not been in trouble since. If she gets support, I don't think we will see her in court again."

Sheriff Sara Matheson deferred sentence until September 12 for a background report.
