Man accused of murdering pensioner Frank Kinnis in woods near Elgin deemed unfit to stand trial

The man accused of murdering Elgin 83-year-old Frank Kinnis has been deemed unfit to stand trial.

David Johnstone (35) was due to appear in the dock when his case was called this morning at Glasgow High Court.

However he was not well enough to travel from the State Hospital where he is being detained.

An examination of the facts will now take place on July 27 at Edinburgh High Court.

Judge Lord Arthurson ordered the accused to be detained in the meantime.

Mr Kinnis died after being attacked in Birkenhill Woods, near New Elgin, on October 21.

It is alleged that Johnstone attacked Mr Kinnis as well as two 70-year-olds – Morris Smith and his wife Jan – on the same day.

He is further accused of assaulting two police officers.
