A MORAY man who drove his car while almost five times the legal alcohol limit has been fined £1000 and banned from getting behind the wheel of a vehicle.
Elgin Sheriff Court was told that Stewart Chessor was stopped by police while driving on Thornhill Drive in Elgin at around 2.30am. Police noted that he appeared to be impaired.
Chessor was taken to Elgin Police Station for a breath test at 3.30am, where he gave a reading of 105 micrograms per 100 millimetres of breath. The legal limit is 22mcg.
This is not Chessor's first drinking driving related offence. However, defence solicitor Matthew O'Neill said that he has accepted he made a mistake.
"He was drinking with a friend following the passing of a close friend," Mr O'Neill said. "He had planned to return home in a taxi.
"However, as in many of these cases, while walking past his car the temptation was there to drive home. He fully accepts responsibility and is glad the police stopped him before he drove far."
Chessor's previous drink driving offence, which occurred more than a decade ago, was taken into account by Sheriff Olga Pasportnikov when sentencing him.
He was disqualified from driving for 20 months, to be reduced to 15 months if he sits a drink drivers rehabilitation course, and fined £1000, to be paid at £100 per month.
