Two men appear in court following Keith assault which left man unconscious and permanently scarred

TWO men have appeared in court after an altercation outside a Keith pub left a man lying unconscious and permanently scarred.

The incident outside the Commercial Hotel on Mid Street happened on December 19, 2021 involving the victim and two other men.

In the dock of Inverness Sheriff Court were 27-year-old Robert Anderson of Corskellie, Rothiemay, near Huntly and 24-year-old Frank Smart of Easter Tolmauds, Torphins, Banchory.

They admitted assaulting the man to injury, permanent disfigurement and permanent impairment.

Fiscal depute Robert Weir told Sheriff Sara Matheson that the victim was being restrained by one of the accused but he managed to throw two punches, one of which appeared to have connected with Smart before he broke free and attempted to punch Anderson.

He missed but both Smart and Anderson retaliated and one punched the complainer to the front of the head, and the other to the back.

"He was knocked unconscious and fell to the ground and was kicked on the upper shoulder by Anderson. Both accused then ran off down Mid Street." Mr Weir went on.

The victim was left bleeding heavily from his head and a large laceration to above his left eye.

"An ambulance was called and CCTV from a neighbouring property was viewed and seized which captured the incident.

"The laceration left a 4-5cm permanent scar above the left eye and he suffers numbness to the crown of his head which he has been told is nerve damage." Mr Weir concluded.

Sentence was deferred until May 18 for a background report and restriction of liberty assessment. Bail was continued for both men.
