Moray courts: Man ordered to pay takeaway owner £600

A defendant who broke a takeaway's window and shouted racist abuse has been ordered to pay his victim £600.

Sean McNamara had already admitted destroying property and acting in an abusive manner in Keith.

McNamara returned to Elgin Sheriff Court today to be sentenced.

On September 2 last year, the victim was working in the kitchen of the Sunset takeway on Mid Street when, at about 6.45pm, he heard a loud smash.

On going out of the back door to investigate he encountered McNamara.

Fiscal Depute Shay Treanor said: "Before he even said anything, the defendant called him a ****".

"As he walked away he became aware that the accused had picked up some stones and was throwing them at him."

The police were called and McNamara was arrested.

When viewed later CCTV footage of the incident showed the 25-year-old smashing the takeaway's window.

Addressing the court on behalf of McNamara, defence solicitor Matthew O'Neil said: "He is appalled by his own behaviour."

Mr O'Neill added that on the day of the offence his client had attended the funeral of a family friend.

Afterwards he'd gone for drinks at a pub but had got into an argument with some of his relatives.

"Angry and frustrated", he lashed out at the window while walking away from the bar.

At McNamara's first court appearance it was stated that he no longer drank alcohol.

It was added that he'd referred himself to Arrows, the Moray-based service that aims to help people with addiction problems.

McNamara was ordered to pay his victim £600 to replace the window and to compensate for the alarm he'd caused.
