Elgin Sheriff Court heard that Colin Shand (41), of Mossmill Park, had left work on the evening of August 22, 2022 and had made a stop at a shop, where he purchased beers.

Subsequently, he was persuaded by a friend to visit a nearby pub, where he consumed two pints before deciding to drive home, and collided with the disused railway bridge on North Street in Rothes.

Following the incident, tests were conducted after the accused was apprehended and he was found to be twice over the legal alcohol limit with 106mg of alcohol in 100ml of blood.

Shand who had been employed as a scaffolder, had handed in his notice at work just three days before his court appearance on Thursday (May 18), as he anticipated the loss of his licence.

When asked about his actions Shand, who chose to represent himself and admitted driving with excess alcohol, stated: "I don't have a problem with drunk driving, this was just a one-off mistake."

When Sheriff Olga Pasportnikov questioned Shand on a previous drink driving conviction he added that he had been "young and stupid".

Shand was fined £1000 and banned from driving for 20 months.
