Police found Elgin man 'bare-chested and sweating profusely' after nappy changing argument

AN Elgin man has received bail for threatening his partner during a nappy changing argument.

Police attended an address in Elgin on November 7, 2022, following an argument between David Jess (29) and his partner.

Addressing Elgin Sheriff Court, Depute Fiscal Sharon Ralph said: "At 3.30pm, an argument occurred between the victim and accused while they were changing his sons nappy.

"The accused said she should have changed it sooner.

"He started shouting abuse at her, calling her fat.

"A neighbour heard him shouting aggressively and was concerned about the welfare of the victim.

"She called the police, who attended and found the accused bare-chested and sweating profusely."

Jess, of Croft Road, Elgin was charged with behaving in a threatening or abusive manner and of shouting, swearing and uttering offensive remarks toward his partner.

He pleaded guilty to the charge.

Defending Jess, solicitor Ben Thom said: "This was the straw that broke the camel’s back.

"There was an argument about the changing of the nappy, but that was not the sole cause.

"Mr Jess had other concerns about his son’s health.

"He has never appeared here in relation to a domestic matter before.

"He accepts his responsibility for this incident.

"Matters have gone back to being stable with his partner."

Sentencing was deferred for the preparation of up-to-date reports.

Sheriff David Harvie released Jess on bail, and encouraged him to engage with relevant services including anger management.
