Sex offender (70) who kissed a woman in Elgin pub jailed and immediately released

A 70-year-old sex offender who kissed a woman in an Elgin pub in defiance of a court ban ordering him not to approach females he didn't know has been jailed for 22 months.
However James Farquhar, described as an Inverness prisoner, will be released immediately as his sentence at Inverness Sheriff Court was backdated to August 5, 2022 when he was first remanded in custody.
Farquhar, who appeared in court on Monday, admitted sexually assaulting the woman in the Muckle Cross bar on July 21, 2022 by attempting to cuddle her, repeatedly touching her hand and kissing her on the lips.
He also admitted the breach of a Sexual Offences Prevention Order which was imposed after he had been jailed for 18 months at Elgin Sheriff Court on April 25, 2012 for 18 months for another sex offence.
He was also placed on the Sex Offender's Register indefinitely,
Defence solicitor advocate Mike Chapman told Sheriff Sara Matheson: "He can provide no cogent explanation for this incident. The kiss was clearly unwanted but very brief."
Sheriff Matheson also placed Farquhar on the Sex Offender's Register for 10 years.
